About this document
These Terms of Service ("Terms") are the agreement between you and Awiser. They cover what Awiser is, what you can do on it, what you cannot do, and who is responsible when something goes wrong.
Please read them. If you do not accept them, do not create an account and do not use Awiser.
1. Who operates Awiser
Awiser is operated by Valentin LAFONT, a French national currently residing in South Korea, acting as an individual. As of the effective date of these Terms, Awiser is not operated by an incorporated entity. Valentin LAFONT intends to transfer the operation of Awiser to a French legal entity once incorporated (see §20. Assignment).
Contact for all legal, privacy, intellectual-property, and copyright matters: privacy@awiser.co
Address for legal notices: Paris, France.
Throughout these Terms, "Awiser", "we", "us", and "our" refer to Valentin LAFONT acting as operator of Awiser. "You" and "your" refer to you as a user of Awiser.
2. Acceptance and scope
By creating an account or using Awiser, you confirm that you have read and accept these Terms, the Acceptable Use Policy, the Privacy Policy, the Cookie Policy, and the IP and DMCA Policy. Together, these documents govern your use of Awiser.
If you use Awiser on behalf of another person or organization, you confirm that you are authorized to accept these Terms on their behalf, and "you" in these Terms refers to both you personally and that person or organization.
3. Eligibility
You must be at least sixteen (16) years of age to create an account on Awiser. By creating an account, you represent and warrant that you are at least 16 years old and legally capable of entering into a binding agreement under the law of your country of residence.
If you are under 16, you must not use Awiser and must not submit any personal data to Awiser.
In the United States, Awiser does not knowingly collect personal information from children under 13 as defined by the Children's Online Privacy Protection Act (COPPA). If you believe a child under 16 has provided personal data to Awiser, please contact privacy@awiser.co and we will delete the account and associated data promptly.
4. Your Awiser account
4.1. Creating an account
You can create an account by signing up with an email address and password or by using a supported third-party sign-in provider (currently Google, GitHub, Discord, and LinkedIn). Details on what data each provider shares with Awiser are in the Privacy Policy.
You agree to:
- Provide accurate information during signup
- Keep your contact details up to date
- Keep your password or sign-in credentials secure
- Notify Awiser promptly at
privacy@awiser.coif you suspect unauthorized access to your account
You are responsible for activity that occurs under your account, unless it results from Awiser's gross negligence or fraud.
4.2. One account per person
You may only hold one Awiser account. Creating multiple accounts to inflate referral counts, game achievements, or circumvent suspension is prohibited and may result in suspension or termination of all associated accounts.
4.3. Account suspension and deletion
You may delete your account at any time via the account deletion flow in your account settings. When you delete your account, Awiser removes most of your data as described in the Privacy Policy. Some data is retained — most notably, public achievement credentials may persist in anonymized form (see §7. Achievements), and account-deletion feedback is retained for up to twelve months. The full list is in the Privacy Policy.
Awiser may suspend or terminate your account as described in §13. Suspension and termination.
5. Your content and license to Awiser
5.1. Content ownership
You keep all rights in the content you create and upload to Awiser, including posts, capsules, projects, messages, achievements, bios, and media. These Terms do not transfer ownership of your content to Awiser.
5.2. Licence you grant to Awiser
To operate Awiser, display your content to other users, and provide the features described on the service, you grant Awiser a non-exclusive, worldwide, royalty-free, sub-licensable license to host, store, reproduce, adapt, publish, publicly display, and distribute your content only for the purpose of operating, improving, and promoting Awiser.
This license lasts for as long as the content exists on Awiser and, in relation to content shared with other users (for example direct messages), for as long as that other user's copy exists. Deleting content or your account ends the license except where the license is required to serve another user's copy.
5.3. Your warranties about your content
For every piece of content you submit to Awiser, you represent and warrant that:
- You own the content or have obtained all rights necessary to submit it
- Your content does not infringe any third party's intellectual-property, privacy, publicity, or contractual rights
- Your content is not defamatory, harassing, threatening, fraudulent, or otherwise unlawful
- Your content complies with the Acceptable Use Policy
5.4. Moral rights
To the extent permitted by your country's law, you waive — or agree not to assert against Awiser — moral rights in your content to the extent necessary for Awiser to exercise the license in §5.2. This is limited to what is necessary to operate the service.
5.5. Feedback
If you send Awiser suggestions, ideas, or feedback about the service, Awiser may use them for any purpose without obligation or compensation to you.
6. Acceptable use
Your use of Awiser is subject to the Acceptable Use Policy, which is part of these Terms. The AUP prohibits — among other things — illegal content, harassment, impersonation, spam, malware, and attempts to attack or gain unauthorized access to the service.
If you see content or behavior that violates the AUP, please report it by email to privacy@awiser.co with the subject line "Report". Details of the reporting and action process are in the AUP.
7. Achievements
Awiser issues achievements — informational credentials that reflect user activity on the platform at the time they are earned. Examples include activity-count achievements (number of projects published, claps received, and similar).
Achievements are informational, not legally vested rewards. Awiser may at any time and with or without notice:
- Introduce new achievement categories
- Modify or retire existing categories
- Change the thresholds required to earn an achievement
- Revoke any achievement found to have been earned through violation of the Acceptable Use Policy, including but not limited to multi-accounting, coordinated referrals, or other gaming of achievement signals
Achievements have a public verification page accessible at /achievement/:code and /verify/:code. These pages display your full name, username, and profile picture unless you have set the achievement to private. If you delete your account, achievement verification pages may remain accessible in anonymized form — your name and picture are removed, but the achievement type, earned date, and verification code persist. See the Privacy Policy for details.
Achievements are not money and carry no monetary value. They are not redeemable.
8. Collaboration between users
Awiser provides tools for users to discover, connect with, and collaborate with one another, including profile pages, messaging, project pages, and cofounder or contributor invitations.
Awiser is not a party to any agreement, understanding, or relationship you form with another user. Awiser does not represent, endorse, warrant, or guarantee any user, project, cofounder, contributor, team, or collaboration on the service.
You are solely responsible for your own agreements with other users, including intellectual-property assignments, cofounder terms, compensation arrangements, equity splits, contribution terms, and dispute resolution. Awiser strongly recommends that you sign written cofounder, contributor, or work-for-hire agreements outside Awiser before committing significant work to any collaboration.
Awiser is introduction-infrastructure. Awiser is not your agent, partner, employer, employee, co-founder, investor, or fiduciary, and nothing on Awiser creates such a relationship.
9. Communications
Awiser offers direct messaging between users. You can leave any direct-message conversation at any time via the "quit" action on a conversation room. Awiser does not currently offer a user-level block feature and may introduce one in the future.
Harassment, threats, and abuse via messaging are prohibited under the Acceptable Use Policy. Report such conduct to privacy@awiser.co.
When another user deletes their account, direct-message conversations you shared with them may be deleted in full, including your own messages within those conversations. Awiser is working to change this behaviour. Until then, save important messages outside Awiser if you need to retain them.
10. Third-party services and international transfers
Awiser uses third-party services to operate. Current third parties include:
- Sign-in providers: Google, GitHub, Discord, LinkedIn
- Infrastructure: OVH (France) for the user database; Amazon Web Services (Sydney, Australia) for media and CDN; Namecheap (United States) for transactional email
- Analytics and session replay: Google Analytics, Google Tag Manager, Hotjar
A full list of sub-processors, the data each receives, and the legal basis for any cross-border transfer is in the Privacy Policy.
When you use Awiser, your personal data may be transferred to and processed in countries other than your country of residence, including France, Australia, and the United States. The Privacy Policy describes the safeguards that apply.
11. Awiser's intellectual property
"Awiser", the Awiser logo, the Awiser website and platform, the software powering the service, all page layouts, user-interface elements, visual design, icons, and documentation are owned by Valentin LAFONT or are used under license. You may not copy, modify, distribute, reproduce, publish, license, sell, or create derivative works from them without prior written permission, except as permitted by mandatory law.
Nothing in these Terms transfers any right in Awiser's intellectual property to you. You receive a limited, non-exclusive, non-transferable, revocable license to use Awiser in accordance with these Terms.
12. Copyright and takedown requests
Awiser respects the intellectual-property rights of others and expects users to do the same. If you believe content on Awiser infringes your copyright, please follow the process in the IP and DMCA Policy.
Repeat infringers will have their accounts suspended or terminated.
Awiser's designated contact for copyright and IP matters is privacy@awiser.co.
13. Suspension and termination
Awiser may suspend or terminate your account, with or without notice, for:
- Violation of these Terms or the Acceptable Use Policy
- Activity that Awiser reasonably suspects to be illegal or harmful
- Extended inactivity
- Operational reasons, including security, abuse mitigation, or discontinuation of the service
- Any reason required by applicable law, court order, or competent authority
You may terminate your account at any time via the account deletion flow. Your obligations under §5.3, §14, §15, §16, §17, §18, and §19 survive termination.
14. Disclaimer of warranties
Awiser is provided "as is" and "as available". To the maximum extent permitted by applicable law, Awiser disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation:
- Warranties of merchantability, fitness for a particular purpose, title, and non-infringement
- Warranties that the service will be uninterrupted, secure, error-free, virus-free, or meet your requirements
- Warranties regarding the accuracy, reliability, completeness, or timeliness of content on the service
- Warranties regarding other users, their content, their projects, or their intentions
Awiser does not offer a service-level agreement. Awiser may change, suspend, or discontinue all or part of the service at any time.
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including consumer-protection law applicable to you.
15. Limitation of liability
To the maximum extent permitted by applicable law, the total aggregate liability of Awiser and Valentin LAFONT to you for all claims arising from or relating to these Terms or your use of Awiser is limited to the greater of (a) one hundred euros (€100) or (b) the amount you paid to Awiser in the twelve (12) months preceding the event giving rise to the claim.
Awiser is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss, corruption, or inaccuracy of data, even if Awiser has been advised of the possibility of such damages.
Nothing in this section limits liability for:
- Fraud or fraudulent misrepresentation
- Gross negligence
- Personal injury or death caused by negligence
- Any liability that cannot be limited or excluded under applicable law
If you are a consumer residing in the European Economic Area, the mandatory consumer-protection rules of your country of residence apply regardless of this section.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Valentin LAFONT and Awiser against any claim, demand, loss, liability, damage, penalty, fine, cost, or expense (including reasonable legal fees) arising from or related to:
- Your use of Awiser in violation of these Terms or the Acceptable Use Policy
- Content you submit to Awiser
- Your violation of any law or any third party's rights
- Your interactions or agreements with other users, including cofounder or collaboration disputes
Awiser may assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Awiser's defense.
This section does not apply where it is unenforceable against consumers under applicable law.
17. Informal dispute resolution
Before filing any legal action arising from or relating to these Terms or your use of Awiser, you agree to contact Awiser at privacy@awiser.co with a written description of the dispute and attempt in good faith to resolve it informally.
Awiser and you will confer in good faith for at least thirty (30) days from the date of the written notice. If the dispute is not resolved within this period, either party may proceed to court under §18. Governing law and venue.
This section does not apply where it is unenforceable under applicable law and does not prevent either party from seeking urgent injunctive relief in a competent court.
18. Governing law and venue
These Terms and any non-contractual obligations arising from or connected with them are governed by the laws of France, excluding its conflict-of-laws provisions.
Any dispute arising from or relating to these Terms that cannot be resolved informally under §17 will be brought exclusively before the competent courts of Paris, France.
Nothing in this section deprives consumers residing in the European Economic Area of the mandatory protections afforded to them by the laws of their country of residence.
Nothing in this section waives mandatory consumer-protection rights afforded to users residing in the Republic of Korea under Korean law.
19. Class-action waiver
Where permitted by applicable law, you and Awiser agree that any dispute will be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
This section does not apply, and no class-action waiver is claimed, where such waivers are unenforceable. This includes, without limitation, where you are a consumer residing in the European Economic Area under the Unfair Contract Terms Directive (Council Directive 93/13/EEC).
20. Assignment
You may not assign or transfer these Terms or any rights or obligations under them without Awiser's prior written consent. Any attempted assignment without consent is void.
Awiser may assign these Terms without your consent to:
- A successor entity, including a French legal entity formed to operate Awiser, in connection with a reorganization, sale of assets, merger, or similar transaction
- An affiliate
- A successor in interest by operation of law
Awiser will provide reasonable notice of any such assignment via the platform, email, or both.
21. Changes to these Terms
Awiser may modify these Terms at any time. Material changes will be notified via the platform, email, or both, at least fourteen (14) days before they take effect. Non-material changes (for example, typographical corrections) may take effect immediately.
Your continued use of Awiser after the effective date of a change constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using Awiser and may delete your account.
The current version and effective date are shown at the top of this document.
22. Severability
If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions remain in full effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.
23. Entire agreement
These Terms, together with the Acceptable Use Policy, Privacy Policy, Cookie Policy, IP and DMCA Policy, and Community Guidelines, constitute the entire agreement between you and Awiser regarding the service and supersede any prior agreement or understanding.
In the event of conflict between these documents, the Terms of Service govern unless a specific provision in another document expressly overrides.
24. Language
These Terms are published in English. The Service is currently provided in English only. If Awiser publishes translations in the future, the English version governs in the event of any conflict.
